On July 2, 2014, the Texas Commission on Environmental Quality (“TCEQ”) acted to deny all pending requests for a contested case hearing and to issue two air quality permits to Freeport LNG Development, L.P (“Freeport LNG”). Freeport LNG applied to the TCEQ for two air quality permits to authorize construction of its non-greenhouse gas sources of emissions to support its Liquefaction Project in Brazoria County. The Liquefaction Project consists of two sites – a Pretreatment Facility that extracts the impurities of pipeline quality natural gas and a Liquefaction Plant that converts the natural gas by a refrigeration process to liquefied natural gas (“LNG”). These air quality permits represent the first such permits for an LNG export facility located in Texas.
