Bill Johnson and Adrian Ciechanowicz represent investors suing their managing member for breach of fiduciary duty in Texas State Court. On the eve of trial, the managing member initiated a bankruptcy proceeding and removed the lawsuit to Federal Bankruptcy Court. On July 30, 2013, after a contested evidentiary hearing, the Bankruptcy Court ruled in favor of DWMR clients and dismissed the bankruptcy. The Court found that the managing member filed the bankruptcy case in bad faith in an effort to avoid trial in State Court. On September 30, 2104, United States District Judge Sam A. Lindsay upheld the bankruptcy court’s decision dismissing the appeal with prejudice. In the related proceeding in Texas State Court, the Court entered a judgment in excess of $36 million in favor of Mr. Johnson’s and Mr. Ciechanowicz’s clients in February 2014. Defendants are currently appealing that judgment.
